The use of the FOMO platform is governed by the general conditions of use (“CGU”) detailed below.

FOMO owns, reserves and retains all property rights, in particular intellectual property, including reproduction rights to this Platform and the elements it contains. Consequently, and in particular, any partial or total reproduction of the Platform and the elements it contains is strictly prohibited without the written authorization of FOMO.

No right of use or license can be granted on any of these elements without the written authorization of FOMO or the third party holder of the rights.

Use of the platform implies unreserved acceptance of the T&Cs. Any user by the simple fact of using the platform acknowledges having read these T&Cs and accepts them.

FOMO reserves the right to modify the terms of the T&Cs at any time and without notice. Changes are effective immediately upon posting of the changed Terms on the Platform.

FOMO reserves the right to refuse access to the Services of the Platform, unilaterally and without prior notification, to any User who does not comply with these terms of use.

FOMO reserves the right to suspend or modify access to all or part of the Services without notice, without the interruption giving rise to any obligation or compensation.

The Platform: refers to the mobile applications and the FOMO website.

CGU: designates these general conditions of use of the platform.

User Content: refers to the data transmitted by the User in the various sections of the platform.

Browsing data: refers to information related to the connection of your terminal to the platform. We are likely to use this navigation data for statistical purposes.

Personal data: refers to information related to Users. This may be the history of use of the Services by the User.

Partner Content: designates all the sources / companies with which we have a direct or indirect partnership contract.

Services: refers to all the services, paid or free, accessible to Users.

User(s): refers to one (or all) person(s) registered on the platform

The User is solely responsible for the User Content that he puts online via the Services, including in particular the recommendations that he publishes on the Platform. He undertakes in particular that this data is not of a nature to infringe the legitimate interests of third parties, whatever they may be.

FOMO declines all responsibility in the event of appeal, based directly or indirectly on these remarks and/or data, which may be brought by anyone against FOMO. He undertakes in particular to take charge of the payment of sums, whatever they may be, resulting from the recourse of a third party against FOMO, including lawyers' fees and court costs.

FOMO reserves the right to delete all or part of the User Content, at any time and for any reason whatsoever, without prior warning or justification. The User cannot make any claim in this regard.

FOMO reserves the right to exclude a User if his behavior on the platform is not appropriate without the latter being able to take any action and this data will be automatically deleted.

FOMO is required to retrieve and/or redirect the user to Partner Content from external sources which are by nature independent and over which, consequently, FOMO has no control over this information and thus declines all responsibility for the content displayed in all its forms. Each source / site is governed by its own terms of use.

FOMO cannot be held responsible for errors, omissions, or the lack of availability of information and services.

FOMO reserves the right at any time and without notice to make improvements and/or modifications to the content of its application. Consequently, the user acknowledges using his information under his exclusive responsibility.

FOMO undertakes to put in place all the necessary means to guarantee the security and confidentiality of data.
